Unreasonable Refusal to Rehire

An employer who refuses to rehire an employee without reasonable cause after the employee has sustained an industrial injury may be found liable for up to one year of lost wages. Refusal to rehire may also apply when an employer terminates an employee while he or she is still healing following a work related injury or if the employee is hired back and later terminated without cause.
