October 20, 2009 Update


  1. The retirees' response to CUNA Mutual's Motion to Dismiss was filed with the Court on September 16, 2009. A copy is posted to this website here.


  2. CUNA Mutual has two weeks to respond. This will complete the briefing and the case will then be ready for decision.


  3. The Magistrate Judge advised us that the case would be assigned to the next District Judge who will be confirmed by the Senate. Louis Butler was nominated by President Obama on September 30, 2009. The American Bar Association Judicial Committee unanimously rated him well qualified. A hearing date before the Senate Judiciary Committee has not been scheduled as of this posting. This means it might be another 60 days before he is confirmed by the Senate. This means it is possible that this Motion might be decided by Judge Crabb. A decision on the Motion will be decided by the Court's workload and a decision date cannot be predicted.


  4. CUNA Mutual has changed law firms and is now being represented by the law firm of Sonnenschein, Nath, and Rosenthal, LLP of Chicago. This firm replaces Jackson Lewis of White Plains, New York.
