September 1, 2011 Update

Lawton & Cates will petition the Seventh Circuit Court of Appeals to have the CUNA Mutual Retirees Class Action case heard by the entire active panel of nine judges.

The attorneys and the class representatives conferred on September 1, 2011 and decided to petition the Seventh Circuit Court of Appeals to have the case heard by the entire active panel of 9 judges.  This is a discretionary procedure and usually the court denies the petition without a hearing.  It takes a majority of the ten judges to grant such a petition.  If the petition is granted the court will schedule another hearing and issue another decision.  It will take the vote of 6 judges to reverse the current decision.

Our petition is due on September 21, 2011.  Check back to this website on that date and our petition should be posted.
