What is a Custody Evaluation?

When mom and dad cannot agree on custody or placement and mediation has not been successful, the court may order a custody evaluation. In Dane county, the counselors at the family court counseling services will act as the custody evaluator. They will do an investigation that may include contacting care providers, educators, health providers, or other folks that will have pertinent information regarding the best interest of the children. Ultimately the custody evaluator will be held responsible for making a recommendation to the court as to what he or she believes is in the child’s best interest. In Dane county the custody evaluators have up to 135 days to prepare their recommendation. They can seek an extension if necessary.
