Are our property and debts always divided 50/50?

Shane Falk discusses the division of property and debts in a divorce.

Wisconsin is a marital property state and generally that means that it's presumed that in any marriage, debts, as well as assets, are divided equally at the end of a marriage. However, that can be altered based on the length of the marriage, if it's particularly brief, if you have a prenuptial agreement that, in Wisconsin, we call a marital property agreement that could alter the 50/50 split. If a spouse has wasted assets through gambling, or some other form of addiction that could also altar that 50/50 split. So it depends on the circumstances generally you start from the presumption of a 50/50 division of property with both parties getting equal amounts at the end. However, there are certain circumstances where that can me modified.
